What is a labour quota application?
To hire foreign workers in Sarawak, you need an approved labour quota from the labour department. The labour quota will state how many foreign workers you are allowed to hire at your worksite. You can proceed to apply for permits for new applicants with the immigration department only after you get your labour quota approval or approval in principle (AP) from the labour department.
Who needs it?
Companies who wish to hire foreign workers need labour quota approvals. However, not all companies and vacancies are eligible to hire foreign workers. For example, in Sarawak, only Sarawakians can work as security guards. Some industrial zones in Sarawak are also designated for local employment only where labour quotas will not be provided.
Companies in Sarawak can hire foreign workers in manufacturing, construction, agriculture/ plantation, transportation and service industries only. Household employers can hire foreign domestic helpers for their households. Labour quota approval is not required for household employers.
How to apply for labour quota?
To apply for a labour quota, you will first have to register yourself with the labour department in Sarawak. Thereafter, you are required to submit the following documents:
- Cover Letter
- Borang JTKSWK 27A
- Business license (industry specific)
- Business registration certificate
- Company incorporation documents
The labour quota approval will be approved subject to the labour department's assessment and recommendation. This process may take up to 6 months. You are advised to apply early to avoid delays to your hiring needs.
